Scope
These General Terms and Conditions (GTC) apply to all business between Emotional Escort – Daniela Scherler and its clients. They apply during the complete duration of the business relationship. These terms are deemed accepted with commissioning. Deviations from these GTC must be agreed upon in writing in advance.
Customer’s Obligation to Cooperate
The consultation is based on the preparatory meeting held between the parties to arrange the respective dates. It is based on cooperation and mutual trust. The conversations are a free, active, and self-directed process in which specific outcomes cannot be guaranteed. The Emotional Escort will support the client as a listener, supporter, and advisor in conflictual and transitional situations as well as in taking decisions. The actual work of changing is done by the client.
Scope and Conditions of work
The scope of work is two hours, unless explicitly agreed. At the beginning of a consultation, Emotional Escort - Daniela Scherler will clarify the expectations for the consultation with the client. The hourly rate (60 minutes) is €150.
The meetings with Emotional Escort - Daniela Scherler require advance payment. After receipt of the invoice, the amount of the fee must be paid by bank transfer or in cash before the consultation.
Consultations are billed as alternative medicine services and are therefore not subject to VAT.
Expenses
Additional expenses for food and beverages by Emotional Escort and the client are to be paid for by the client.
For consultations outside Potsdam, an amount will be charged as travel time. This amounts to E 150 per hour or part of this in proportion to the time spent. The amount of 50 cents per kilometer will be charged as travel expenses.
The prices quotet can be negotiated individually.
Cancellation Policy / Cancellation Fees
Appointments can be cancelled free of charge up to 24 hours before. Appointments for Mondays must be canceled until 12:00 pm the Friday before. The full fee is due for any cancelation after these deadlines.
Confidentiality
Emotional Escort Daniela Scherler is bound to confidentiality in accordance with Section 3 of the Professional Code of Conduct for Alternative Practitioners (BOH), hence confidentiality applies. Daniela Scherler will maintain absolute confidentiality towards third parties regarding all private and professional matters of the client that become known in the course of her work, even after the contract has ended. Unlike doctors, however, Emotional Escort Daniela Scherler is not subject to medical confidentiality in accordance with Section 204 of the German Criminal Code (StGB). Therefore, she is obliged to provide information to public prosecutors and courts. Furthermore, there is a legal obligation to report certain serious, planned crimes and to prevent endangering the well-being of a child or adolescent.
Liability
Emotional escort is constitutes purely a service. Success is neither guaranteed nor owed. Any liability is excluded.
Place of Jurisdiction
The place of jurisdiction is Potsdam. German laws apply.
Final Clause
Should individual provisions of the contract with the client, including these General Terms and Conditions, be or become invalid the invalidity shall not affect the validity of the remaining provisions. The invalid provision, whether in whole or in part, shall be replaced by a provision whose economic effect comes as close as possible to that of the invalid one.
